What to Do If Your Ex Isn’t Complying with a Family Court Order in California

Family court orders are legally binding in California, and both parties are required to comply with the terms. These orders can include custody arrangements, visitation schedules, child support, spousal support, or property division. However, it’s not uncommon for an ex-spouse to fail to follow through with these obligations. If your ex isn’t complying with a family court order, knowing the right steps to take can protect your rights and help you enforce the court’s decision.

1. Understand the Court Order

The first step is to carefully review the existing court order. Make sure you understand exactly what your ex is required to do and whether the order leaves any room for interpretation. Courts enforce clear, specific orders, so documentation is key.

2. Document All Violations

Before taking legal action, collect evidence of the noncompliance. Keep records such as:

  • Missed support payments
  • Texts, emails, or messages showing violations
  • Logs of missed visitation or custody exchanges

Thorough documentation strengthens your case if you need to return to court.

3. Attempt Communication First

If it is safe to do so, you may attempt a polite, documented communication with your ex to remind them of their obligations. Sometimes, violations occur due to misunderstandings or temporary personal issues. Written communication is best because it creates a record.

4. File a Motion for Contempt or Enforcement

If your ex continues to ignore the order, you can file a motion for contempt or a motion to enforce the order with the family court. A judge may take various actions, including:

  • Ordering compliance with the original court order
  • Imposing fines
  • Awarding attorney’s fees
  • In extreme cases, ordering jail time for willful disobedience

5. Consider Legal Representation

Family law issues can be emotionally and legally complex. A skilled attorney can guide you through the enforcement process, present evidence effectively, and ensure your rights are protected.
